CLINICAL NEGLIGENCE CLAIMS

GP Negligence

The most frequent points of contact that the public have with the NHS are usually the GP’s surgery and the A&E department of the local hospital. Notwithstanding any delays in treatment most members of the public are positive about the way in which both these places are run however it is regrettable that they are both also the places where clinical negligence claims are most often likely to arise.

GP's Are Insured

Whilst only a few patients do actually make claims against their family doctor it should be noted that it is a requirement that general practitioners are insured. This means that any medical negligence compensation award made against a GP is paid, not out of that particular GP’s pocket but by the insurers.

Serious Consequences

Because a GP is often the first point of contact, the consequences of medical negligence can be serious and far reaching. A mis-diagnosis at this early stage can mean the difference between life and death particularly in cancer cases. GP’s who are not experienced or who are uncertain should always refer a patient on to a consultant or a specialist.

Fully Trained Doctors

One of the main problems in A&E relates to the fact that the Doctors practicing there are often inexperienced and are learning their skills whilst on the job. There is however supposed to be adequate supervision by more senior experienced doctors, consultants and specialists but this is not always the case.
